BAMS Academy Terms of Service

Welcome to BAMS Academy! These Terms of Service ("Agreement") govern your access to and use of the BAMS Academy Learning Hub, available at academy.bamstech.com and any related apps (collectively, the "Service"). The Service is a K-12 practice platform covering Math, Science, English, Social Studies, and Computer Science. By creating an account or otherwise using the Service, you agree to this Agreement. If you do not agree, do not use the Service.

This Agreement is specific to BAMS Academy and governs the Learning Hub product only. It is separate from, and does not incorporate, the general Terms of Service published at bamstech.com, which apply to BAMS Technology Group's other websites and products.

WHO CAN USE THE SERVICE

The Service is designed for students in grades 1–12 and their parents or guardians. A student account may be created by the student directly or by a parent/guardian on the student's behalf. If you are under the age of 13, a parent or legal guardian must create or approve your account and agrees to this Agreement on your behalf. Parent accounts must be created and managed by an adult (18 or older). We do not knowingly allow children under 13 to create or manage their own account without parental involvement.

ACCOUNTS

To use the Service, you must register for an account and provide accurate information, including a name, email address, and (for student accounts) a grade level. You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately at support@academy.bamstech.com if you suspect unauthorized use of your account.

A parent account may be linked to one or more student accounts, either by the student adding a parent email in their profile settings or by the parent sending an invite. Linked parents get read-only visibility into that student's practice activity and progress — not the ability to answer questions or otherwise act as the student.

FREE TRIALS AND SUBSCRIPTIONS

New accounts may start a free trial with full access to the Service, as described at the time of signup. No credit card is required to start a trial. After the trial ends, continued access to unlimited practice questions, the AI tutor, and advanced analytics requires an active paid subscription (Student Basic, Student Pro, or Family Plan, as described on our Subscription page), billed monthly or annually through our payment processor. Free accounts retain limited access (a fixed number of practice questions per subject/difficulty). You may cancel a subscription at any time; cancellation takes effect at the end of the current billing period, and we do not provide prorated refunds for partial periods except where required by law.

ACCEPTABLE USE

The Service is for personal, non-commercial educational use by students and their families. You agree not to: share your account credentials with anyone outside your household, attempt to circumvent usage limits or paywalls, scrape or bulk-extract questions or explanations from the Service, use the Service to harass or harm another user, or use the AI tutor to generate content unrelated to educational practice. We may suspend or terminate accounts that violate this Agreement.

CONTENT AND INTELLECTUAL PROPERTY

All practice questions, explanations, curriculum mappings, software, and other materials made available through the Service (the "Materials") are owned by or licensed to BAMS Academy and are protected by copyright and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Materials solely for personal educational use while your account is active. You may not copy, resell, redistribute, or create derivative works from the Materials without our written permission.

AI TUTOR

The Service includes an AI-powered tutor that provides hints, explanations, and practice recommendations. AI-generated responses are provided for educational support and may occasionally be incomplete or contain errors; they do not replace instruction from a teacher and should not be relied on as the sole source of academic guidance.

DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT USE OF THE SERVICE WILL RESULT IN ANY PARTICULAR ACADEMIC OUTCOME.

LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, BAMS ACADEMY AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR $100, WHICHEVER IS GREATER.

PRIVACY

Our BAMS Academy Privacy Policy describes how we collect, use, and protect information on the Service, including student data, and is incorporated into this Agreement by reference.

CHANGES TO THESE TERMS

We may update this Agreement from time to time. If we make a material change, we will notify account holders (and, for student accounts under 13, their linked parent) by email or an in-app notice before the change takes effect. Continued use of the Service after a change takes effect means you accept the updated terms.

GOVERNING LAW

This Agreement is governed by the laws of the State of Connecticut, without regard to its conflict of laws principles.
